Magistrate says she is not biased towards mom and we are both equal. Mom is a completely confident she has a slam dunk and will get primary custody so she is doing zero preparation.So I have a chance to win this if I can argue my points according to the law. while that stuff is INCREDIBLY helpful I have actually heard it before|||You do not mention the age of the child.
If the child is young unless the parent it lives with now and who provides primary care is proved unfit the custody is going to go to that parent as it will cause less trauma to the child. If you are the primary care giver you have to show that you do most of the actual care (feeding, changing, keeping the house clean, etc) and you are the one that takes the child to the doctor, etc. Whoever has been providing care since birth will continue to unless the child is a teenager. It has nothing to do with the parents, just what is easiest on the child in question.|||If you don't have a lawyer you will lose the case. And that is a fact.|||Yes. Lawyer, get one.
