How do you gather evidence for a custody case?

Magistrate says she is not biased towards mom and we are both equal. Mom is a completely confident she has a slam dunk and will get primary custody so she is doing zero preparation.So I have a chance to win this if I can argue my points according to the law. What kind of evidence can I gather to support my case?





things you dont need to say:





get a lawyer


talk to a lawyer


you really need a lawyer


you are stupid for not using a lawyer





while that stuff is INCREDIBLY helpful I have actually heard it before|||Why don't you just both but the child(ren) first. The child(ren) need both a mom and a dad, set your differences aside and learn to co-exist as parents and co-parent together. Share equal time with them, you have the child(ren) one week, she has them the next.





For her to NOT get primary custody you would have to prove she:





is an unfit parent


the child(ren) go without necessities like food, water, shelter


the child(ren) are not cared for (go without medical treatment, are sick, are abused)





By wanting to take the child(ren) from their mother or father, the person you're hurting the most is the child...
